2021 Annual Storm Sewer Assessments

New storm sewer main and/or laterals will be assessed for properties along the following streets that do not currently have a storm sewer lateral directly from a City sewer to the property:

  • N Winnebago Street – Fulton Street to Ridgeway Boulevard
  • N Erie Street – George Street to Ridgeway Boulevard
  • James Street – Huron Street to Erie Street

PROJECTS 21-01 & 21-02 PUBLIC INFORMATION MEETING VIDEO

The storm lateral assessment will be due in full when one of the following conditions is triggered:

  • When the property connects to the newly installed storm sewer lateral. Please note that connection will not be mandatory at the time of construction unless there is a known nuisance from a sump pump or surface discharge.
  • When the property is transferred (sold)
  • When the property is subdivided
  • 25 years from when the final assessment resolution is passed

No interest will accrue if the assessment is paid in full within 30 days from when the assessment is invoiced.  After 30 days, interest will accrue for a period of 10 years.

For properties on the roads listed for storm sewer assessments, we will install the lateral up to your property line, on the back side of the sidewalk, and we will work with you to place the storm sewer lateral.  The final connection from your property to the new storm sewer lateral is the responsibility of the homeowner and will need to be made by a licensed plumber.  You will need to obtain a plumbing permit with the City’s Inspection Department.  The 2021 fee for the Plumbing Permit is $125.

Storm sewer lateral installation on N. Erie Street and James Street conforms to the City Municipal Code Section 26-5-5(b) which states:

“(1)      Installation.  Storm sewer main and lateral installation to each lot of record shall be constructed at the time of street reconstruction in those streets which do not have storm sewer.  The location of the lateral installation shall be as determined by the City Engineer or designee.”

The City has had drainage issues in the areas of N. Winnebago Street over the last few years.  Because of this, storm sewer laterals are being installed to properties within these blocks.  The installation of storm laterals conforms to the City Municipal Code Section 26-5-5(c) which states:

“(1)      Installation.  Storm sewer main and lateral installation to each lot of record shall be constructed at during street resurfacing improvements when:

  1. Requested by a property owner along the street to be resurfaced; or
  2. When ordered by the Director of Public Works to address drainage issues.

The location of the lateral installation shall be as determined by the City Engineer or designee.”

Assessments for these services were calculated per City Municipal Code Section 13-7.  As calculated per Municipal Code Section 13-7 and approved by the Board of Public Works, the costs for the 2021 storm sewer special assessments are as follows:

  • Residential Properties
    • Storm Lateral Assessment - $1,739.52
    • Storm Main Assessment - $498.10
  • Non-Residential Properties
    • Storm Main Assessment - $8.72
    • 6-inch Storm Lateral Assessment - $2,002.20
    • 8-inch Storm Lateral Assessment - $3,240.52
    • 12-inch Storm Lateral Assessment - $3,701.26

Code Section 13-7(d)(1)(d) further identifies procedures and pay options for the storm sewer and special assessments as follows:

“d. Public hearing.  The board shall hold a public hearing on the assessments and after the hearing may by resolution approve, disapprove, modify or refer the report with such directions as it deems necessary.  The board shall provide for the following payment alternatives if it determines to assess for any of the improvements:

  1. No interest imputed if payment of assessment made in full within 30 days of invoice;
  2. Payment in such number of yearly installments as deemed reasonable by the board, together with interest thereon at the rate of one percent over the interest rate paid by the city on its latest bonding issue, with payment in full due upon transfer of the property;
  • Deferred payment of assessment with interest to accrue at the rate of one percent over the interest rate paid by the city on its last bond issue, with the total becoming due on the earliest of the following:
    1. Transfer of the benefited property to any other person or entity:
    2. Subdivision of the benefited property;
    3. Connection to the storm sewer;
    4. The expiration of 25 years from the date of adoption of the final assessment resolution, at which time the assessment plus accrued interest shall be made in full against the benefited property.

Interest on alternatives ii. and iii. Above shall stop accruing after a period of ten years.”

The Board of Public Works at the March 8, 2021 Meeting approved a five (5) year back option as outlined in section ii. above.

Project 21-01 – Sewer and Water Relay and Street Resurfacing

  • This project consists of a combination of utility construction (water main, storm sewer and sanitary laterals), spot curb and gutter repair, and milling and resurfacing of streets.
  • During utility construction temporary lane closures may occur for utility reconstruction or replacement. There will be instances where you cannot get through the street.
  • If the concrete panel at your driveway is being replaced, you will not be able to use your driveway for up to two weeks depending on the amount of concrete work. You’ll be notified in advance of any access restrictions so you can make other parking arrangements.
  • During paving operations, the roadway will have a moving lane closure.
  • There are assessments for new storm sewer and storm sewer lateral construction on this project.

Project 21-02 – Street Construction and Utility Relay

  • This project consists of the full reconstruction of the street. This includes utility construction (water main, storm sewer and sanitary sewer laterals).  The curb, driveway approaches, and roadway will be completely replaced as part of this project.
  • During utility construction temporary lane closures may occur for utility reconstruction or replacement. There will be instances where you cannot get through the street.
  • When the concrete panel, curb and gutter at your driveway are being replaced, you will not be able to use your driveway for up to two weeks. You’ll be notified in advance of any access restrictions so you can make other parking arrangements.
  • During roadway base preparation and paving operations, the roadway will have a moving lane closure.
  • There are assessments for new storm sewer and storm sewer lateral construction on this project.
