It is the policy of the De Pere Police Department that all juvenile records will be kept separate from adult records and be kept confidential, pursuant to §938.396(l), Wis. Stats., and records of juveniles shall not be open to inspection or their contents disclosed except under the exceptions set forth in this procedure.
 
Wisconsin Statute §938, allows certain persons access to juvenile records without obtaining a court order.  While generally referenced below, additional requirements may apply to the various exceptions. 
  • Legal Guardian or Custodial Parent 
  • Subject of Report
  • Media
  • Victim-Witness Coordinators
  • Victims of the Juvenile Act
  • Insurance Companies
  • Law Enforcement
  • Social Agency
  • Schools as allowed under Wisconsin Statute §118.127
  • Physicians
  • Medical Examiner

Specific requirements to requesting a juvenile record are outlined below.  These requirements must be met prior to the department processing your request. **

  • Any person, agency, business or insurance company requesting a juvenile record must do so in writing.
  • The identity of the requester must be verified prior to any release of information to ensure they are entitled to receive the record.
    • Photo Identification of party requesting record, and
    • a Birth Certificate verifying the relationship with the child, or
    • a Court Order showing legal guardianship

Information will not be released if the case in question is an active or pending investigation or prosecution, and the release of that information would jeopardize the investigation/prosecution, or subject an individual to threats of harm or intimidation.  If the requester is denied information under this policy, the requester should be referred to the appropriate agency for more information.

Please complete the Police Record Request Form and bring it to the department with the appropriate documentation above.  (Forms are also available at the Front Desk)
 
**Please note that if you request a police report that contains information on a juvenile and you do not provide proof of entitlement to the information, juvenile information will be redacted in its entirety.  At any time during your request process, please don't hesitate in contact the Business Manager if you have any questions or concerns.
